Section 10 of the Hindu Marriage Act, 1955 covers judicial separation wherein a Hindu spouse can stay separately from her/ his counterpart on the following reasonable grounds among others
Cruelty inflicted by a spouse, unreasonably deserted the spouse, indulged in adultery or extra marital affair, etc.,
In a country like India, where divorce is still not a preferred option but instances of domestic violence against women especially from their husbands and in-laws are increasing at an alarming rate, thus, provisions like judicial separation and similar other provisions of laws protecting women address such situations and restore justice for women.
